THE INFORMATION NOTE REGARDING PROTECTION AND PROCESSING OF PERSONAL DATA

(“The Information Note”)

1. DATA CONTROLLER

Personal data shall be processed in accordance with the Turkish Personal Data Protection Law no. 6698 (“PDP Law”) by Sempro Danışmanlık, Mühendislik Hizmetleri ve Temsilcilik Ltd. Şti. (“Company”) as data controller, resident in Mustafa Kemal Mah. 2141. Sk. No:22/10 Çankaya/Ankara, within the scope of The Information Note.

2. PURPOSES OF PROCESSING YOUR PERSONAL DATA 

Personal data might be processed in compliance with the fundamental principles and the terms of processing personal data stipulated in the articles 5 and 6 in the PDP Law for;

• Planning and performing of the legal end technical security for the Company and data subjects having business relationship with the Company,
• Performing necessary works and carrying out related work process for being utilized from products to data subjects which are presented by Company or on the name and/or behalf of the Company,
• Performing necessary works and carrying out related work process by Company unit for implementing commercial and/or operational activities of Company,
• Planning and/or performing work and/or commercial strategies of Company.

3. PARTIES AND TRANSFER PURPOSES OF YOUR PERSONAL DATA

Company has right to transfer personal data to Company’s consultants who are resident in Turkey or abroad, suppliers, business partners and the private/public institutions authorized by PDP Law in compliance with the fundamental principles and conditions of processing personal data stated in Article 8,9 stipulated in the PDP Law.

4. METHODS AND LEGAL GROUNDS OF COLLECTING PERSONAL DATA 

Personal data might be collected from data owner via electronic and/or within a written notice so as to;

• Cooperate with data subject in writing (including but not limited to electronic mail address, cargo and post),
• Get guarantee on behalf of Company if needed,
• Provide management of agreement process,
• Carry out risk assessment and feasibility study,
• Follow-up efficiency and performance,
• Increase pleasure and commitment,
• Perform education courses, organizations, travels and such activities,
• Conduct accountancy and finance process,
• Provide exact and current information,
• Achieve survey process if needed,
• Fulfill legal processes including but not limited to execution and litigation process and provide information/document to legally authorized institutions, carry out Company activities as to the legislation and perform all kind of official correspondence and,
• Accomplish risk assessment and feasibility study via open internet resources,
• Fulfill legal processes including but not limited to execution process and litigation via telephone and call center,
• Cooperate with data subject, conduct accountancy and finance process and fulfill Company process in accordance with the legislation via Company mobile application,
• Sale, present and/or follow-up of products and/or services via Company website,
• Carry out survey, accountancy and finance process via Company communication platform,
• Cooperate, get guarantee if needed and sale, present and/or follow-up of products and/or services via Company consultants, business partners, suppliers,
• Cooperate via fax machine.

In the situation of occurring a legitimate interest/legal obligation, concluding or performing a contract and establishment/usage/protection or presence of a right comes into question personal data might be collected with in accordance with the articles 5 and 6 regarding “Conditions of Processing Personal Data” stipulated by PDP Law.

5. YOUR RIGHTS AS THE PERSONAL DATA OWNER LISTED IN 11TH ARTICLE OF PDP LAW

PDP Law Article 11 defines the rights of data owners regarding their personal information. Accordingly, real persons whose data is processed by Company are entitled to learn whether;

• their data is processed,
• the content of data processed and the purpose for processing,
• data is transmitted abroad or to the third-parties resident in Turkey,
• to request rectification of inaccurate and incomplete personal data and in line with the rectification process, notification of third persons that their personal data transferred,
• to request deletion of data no longer necessary and/or amendment of their personal data,
• to object to negative consequences of processed personal data analyzed by solely automatic systems,
• to request recovery of damages if it is derived from unlawful process of personal data and to appeal against procedures.

Depending on the content of your application, our Company shall conclude your request as soon as possible and at the latest within thirty (30) days free of charge. However, if this activity requires a cost, you might be charged from the rate determined by the Personal Data Protection Board.

Specialized personal data including; planning and/or executing of risk assessment activities and/or feasibility studies for selection of Potential/Current Business Partner/Consultant/Supplier/ Agency Private Company/Stock Corporation/Real Person Shareholder, following agreement processes and/or legal requests, planning and/or executing of credit risk assessment activities, absolving of crime proceeds and fighting with terrorism finance, activities regarding identification of clients and suchlike legal and commercial risks, planning and/or executing of the Company's financial risk processes, ensuring the security of Company’s activities, following of the finance and/or accounting of the Company, planning and/or executing the Company's activities required to ensure that the Company's activities are carried out in accordance with the Company's procedures and relevant legislation, providing information to the competent persons and/or organizations, following of the legal affairs, planning and/or executing the sales procedure of products and/or services, planning and/or executing of internal and external training seminars, planning and/or executing training seminars for customers, business partners and employees/authorities/shareholders, managing of relations with customers, business partners or suppliers, and performing activities for planning accommodation and meeting organization, planning and/or executing of procurement processes.

I hereby declare that I have the brief information about processing the personal data of the third-parties (family members, relatives, employees) that I have transferred to Company, within the aforementioned processing purposes, for the reason of the guarantee and the debts arising/to be arisen from the agreements to be established, and accept this text with explicit consent.
